Please read these Terms of Use ("Terms") carefully before using the Cue birthday reminder application ("App") developed by Alina Akalatovich ("we," "us," or "our").
1. ACCEPTANCE OF TERMS
By downloading, installing, or using the Cue app, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
2. DESCRIPTION OF SERVICE
Cue is a birthday and anniversary reminder application that helps users:
• Store and manage birthday and anniversary dates
• Receive push notifications for upcoming events
• Add photos and notes to their reminders
• View events in calendar format
• Use widget functionality for quick access
• Access premium features through subscription
3. USER ACCOUNTS AND DATA
3.1 Data Storage
Your reminder data, including names, dates, photos, and notes, is stored locally on your device and may be synchronized across your devices using Apple's iCloud service if enabled.
3.2 Data Privacy
We respect your privacy. Your personal data is processed in accordance with our Privacy Policy. We do not share your personal information with third parties except as described in our Privacy Policy.
3.3 User Responsibility
You are responsible for:
• Maintaining the confidentiality of your device
• Ensuring the accuracy of the information you enter
• Backing up your data regularly
• Complying with applicable laws when using the App
4. SUBSCRIPTION AND PREMIUM FEATURES
4.1 Free Tier
The App offers a free tier that allows you to store up to 5 reminders. Additional features may be limited in the free version.
4.2 Premium Subscription
Premium features are available through a subscription service provided by RevenueCat. Subscription terms include:
• Unlimited reminders
• Advanced notification options
• Premium themes and customization
• Priority support
4.3 Subscription Management
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage your subscription through your Apple ID account settings.
5. NOTIFICATIONS
The App uses push notifications to remind you of upcoming birthdays and anniversaries. You can:
• Enable or disable notifications in your device settings
• Customize notification timing (same day, day before, week before)
• Set custom notification times
6. PERMISSIONS AND ACCESS
The App may request access to:
• Notifications: To send birthday and anniversary reminders
• Photo Library: To allow you to add photos to your reminders
• Calendar: To integrate with your device's calendar
You can revoke these permissions at any time through your device settings.
7. ANALYTICS AND TRACKING
We use Mixpanel analytics to improve the App's functionality and user experience. This may include:
• App usage statistics
• Feature usage patterns
• Performance metrics
No personally identifiable information is shared with analytics providers.
8. INTELLECTUAL PROPERTY
The App and its content, including but not limited to text, graphics, logos, and software, are owned by Alina Akalatovich and are protected by copyright and other intellectual property laws.
9. PROHIBITED USES
You agree not to:
• Use the App for any illegal or unauthorized purpose
• Attempt to reverse engineer or modify the App
• Interfere with the App's functionality or security
• Use the App to store inappropriate or offensive content
• Share your account with others
10. DISCLAIMERS
The App is provided "as is" without warranties of any kind. We do not guarantee that:
• The App will be error-free or uninterrupted
• Defects will be corrected
• The App will meet your specific requirements
11. LIMITATION OF LIABILITY
In no event shall Alina Akalatovich be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the App.
12. TERMINATION
We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App will cease immediately.
13. CHANGES TO TERMS
We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or our website. Continued use of the App after changes constitutes acceptance of the new Terms.
14. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where the developer is located, without regard to its conflict of law provisions.
15. SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.
